中华人民共和国政府与马耳他共和国政府19988—2000年度文化合作执行计划(附:英文版本)

中华人民共和国政府与马耳他共和国政府,根据1992年8月29日签署的文化合作协定,为进一步发展和加强文化、大众传播、青年及体育领域里的合作,就1998—2000年度执行计划达成以下协议。

一、文化

第1条

双方将促进交换一个传统及当代艺术的展览。

马方将派出一个马耳他当代艺术展览在北京或上海展出,中方将派出一个中国传统艺术和工艺展览。

有关条件及其它组织安排工作将通过外交渠道另行达成一致。

第2条

双方将鼓励民间艺术团组、歌唱家、音乐家及其他表演艺术家在双方艺术节和比赛中进行交流。

中方可派遣一民俗团组或一艺术团组参加马耳他国际艺术节。

第3条

双方将鼓励专业剧团以及导演、歌唱家及其他表演艺术家在戏剧创作领域里的合作。

第4条

马方将按本计划规定的条件接待一中方现代舞蹈团。

第5条

双方将鼓励交换摄影展览。

二、大众传播

第6条

双方将鼓励两国广播电视机构进行交流与合作,具体事宜由合作单位另商。

双方将鼓励两国电影业的合作与交流。

三、青年

第7条

双方将鼓励青年机构和青年组织进行交流以增进两国相互了解。

四、体育运动

第8条

双方将鼓励其相应的全国性、地区性及地方性体育组织之间为促进体育领域内的交流进行直接联系。

第9条

双方还将鼓励两国培养体育教师、教练、体育经营管理人员的相应组织和机构开展直接联系。

第10条

中方将准备考虑马方体育组织希望派遣各种体育教练的请求。

有关条件将通过外交渠道另行商定。

五、组织及财务规定

第11条

依本计划派往对方国家的人员将由派遣方选定。

第12条

派遣方将负担依本执行计划所派人员往返于对方国家首都的国际旅费。

接待方将负担来访者按照访问日程在其境内的旅费。

第13条

双方认为依本执行计划所派人员会说英语较为适宜。

第14条

接待方收到请求后,将在不超过三个月的时间内通知派遣方是否能够接待待派人员,并说明将安排其访问日程的机构。

派遣方将在待派人员抵达前至少两星期告知确切抵达日期和交通方式。

第15条

交换艺术团组以及艺术家时,接待方将负担在其境内组织音乐会的费用、国内交通费、宣传费以及根据本执行计划第二条、第三条和第四条规定的其它费用。

派遣方将在抵达时间前至少两星期告知确切抵达日期及交通方式。

第16条

依照本执行计划交换展览时,派遣方将:

(1).通过外交渠道传递举办展览的建议并在展览开幕前六个月提交技术数据。

(2).负担展览往返接待方首都的运费以及展览整个展出期间的保险费用。

第17条

接待方将:

(1).免费提供合适的展览场所及必要的技术服务并承担在其境内的运输费、宣传费及图录印刷费,为此,派遣方将在展览开幕前不少于三个月的时间内提供有关材料。

(2).承担一名特派人员及其他随展人员停留期间的当地费用,条件与按本执行计划短期来访的表演艺术家相同。逗留时间将通过外交渠道逐案商定。

(3).采取必要措施保证展品安全,并在展品丢失或损坏时,提供全面协助,阐明损坏情况。

六、总则

第18条

本执行计划不妨碍双方通过外交渠道商定的其它活动的实施。

第19条

本执行计划自签字之日起生效,有效期至2000年12月31日。

本执行计划于一九九七年九月一日在北京签订,一式两份,用中文和英文写成,两种文本具有同等效力。

EXECUTIVE PROGRAMME ON CULTURAL COOPERATION BETWEEN THE GOVERNMENTOFTHE PEOPLE'S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE REPUBLIC OFMALTA FOR THE YEARS 1998-2000

(Done in Beijing on the 1st day of September 1997)

The Government of the Republic of China and the Government of theRepublic of Malta;

Acting in accordance with the Agreement on Cultural Co-operation,signed on the 29th August 1992;

Desirous to further develop and intensify the co-operation in thefields of culture, mass media, youth and sports;

Have agreed upon the following Executive Programme for the years1998-2000.

1: CULTUREArticle 1

The parties shall promote an exchange of exhibitions of traditionaland contemporary art.

The Maltese Party shall send an exhibition of Maltese contemporary artto be exhibited in Beijing or Shanghai while the Chinese Party shall sendan exhibition of Chinese traditional arts and crafts.

Terms and other organisational arrangements shall be agreed uponseparately through diplomatic channels.Article 2

The Parties shall encourage the exchange of folk groups, singers,musicians and other performing artists in each other's festivals andcontests.

The Chinese Party may send a folklore group or a troupe of artists forthe Malta International Arts Festival.Article 3

The Parties shall encourage co-operation between professionalensembles as well as directors, singers and other performing artists inthe field of theatrical creation.Article 4

The Maltese Party shall receive, under the conditions of the presentProgramme, a modern Chinese dance group.Article 5

The Parties shall encourage the exchange of photographic exhibitions.

II. MASS MEDIAArticle 6

The parties shall encourage the exchange and co-operation between theinstitutions of radio and television of the two countries. Details will bediscussed separately by the co-operative units.

The Parties shall encourage co-operation and exchange between the filmindustries of the two countries.

III. YOUTHArticle 7

The Parties shall encourage exchanges between youth institutions andorganizations with a view to enhancing the mutual understanding of the twocountries. IV. PHYSICAL EDUCATION AND SPORTSArticle 8

Both Parties shall encourage direct contacts between their respectivesports organisations, at the national, regional and local levels aimed atpromoting exchanges in the field of sports.Article 9

Both Parties shall also encourage the development of direct contactsbetween their respective organisations and institutions responsible forpreparingPhysical Education teachers, coaches, sports managers andadministration.Article 10

The Chinese Party shall be ready to consider requests from sportsorganisations in Malta for the provision of coaches in variousdisciplines.

Terms will have to be agreed separately through diplomatic channels.

V. ORGANISATIONAL AND FINANCIAL PROVISIONSArticle 11

Persons sent to the other country under the present ExecutiveProgramme shall be selected by the sending Party.Article 12

The sending Party shall cover the travelling expenses of the personssent under the present Executive Programme to the capital of the otherParty and back.

The receiving Party shall cover the travel expenses on its stateterritory according to the programme of the stay.Article 13

The Parties consider it appropriate that the persons sent under theexecutive programme speak English.Article 14

The receiving Party shall inform the sending Party not later thanthree months after receiving the application whether the candidates can bereceived and shall indicate the institutions which shall arrange theprogramme of their stay.

The sending Party shall advise the exact date of arrival and the meansof transportation at least two weeks before the arrival of the candidate.Article 15

In case of exchange of artistic groups and individual artists thereceiving Party shall cover the expenses of the organisation of concertson its territory, transport within its state, publicity and other expensesin accordance with the provisions of Articles 2, 3, 4 of the presentExecutive Programme.

The sending Party shall advise the exact date of arrival and means oftransportation at least two weeks before the planned arrival.Article 16

In case of exchange of exhibitions under the present ExecutiveProgramme, the sending Party shall:

a. deliver through diplomatic channels the proposal for theholding of the exhibition and submit technical data not later than sixmonths prior to the opening of the exhibition.

b. cover the expenses connected with the transportation of theexhibition to the capital of the receiving Party and back as well asinsurance expenses of the exhibition for the whole duration of theexhibition.

Article 17

The receiving Party shall:

a. offer free of charge suitable exhibition premises and necessarytechnical services and shall bear transport expenses within its territory,the expenses for publicity and printing of catalogues for which thesending Party shall send materials not later than three months prior tothe opening of the exhibition,

b. bear the local costs connected with the stay of a commissionerand other persons accompanying the exhibition under the same conditions asthose applying to performing artists under the present Executive Programmefor short-term stays. The length of such stay shall be agreed uponseparately in each individual case through diplomatic channels,

c. take necessary measures to safeguard the security of theexhibits and provide its full assistance in claiming damage in case ofloss or damage ofthe exhibits.

VI. GENERAL PROVISIONSArticle 18

The Executive Programme does not preclude the realisation of furtheractivities which the Parties shall agree upon through diplomatic channels.Article 19

This Executive Programme shall come into force on the day of itssignature and shall be valid until 31 December 2000.

Done in Beijing on the 1st day of September 1997 in two originalcopies in the Chinese and English languages, whereby both texts areequally authentic.
