本条例旨在修订有关工厂暨工业经营及雇用妇女、青年及儿童在该处工作之条例。
全文[1955年9月29日]
1.简称
本条例定名为工厂暨工业经营条例。
2.释义
(1)在本条例内,除按照上下文另具意义者外,下开各词应解释如下——
“身体受伤”包括健康受损;
“儿童”之意义与《雇佣条例》(第57章)所载定义相同;
“处长”指根据第3条所委任之劳工处处长,除有引用“劳工处处长”一词之处外,并指任何副处长、助理处长及被委任为高级劳工主任、劳工主任、职业健康科顾问医生、高级职业健康科医生、职业健康科医生、职业环境卫生师、首席工厂督察总监、副首席工厂督察总监、工厂督察总监或工厂督察分区主任之人士。
“建筑工程”指——
(a)第三附表指定之任何建筑物或工程之兴建、竖立、安装、重建、修葺、保养(包括重新装修及外部清洁)、翻新、迁移、更改、改良、拆除或拆卸;
(b)(a)段所述任何工程之准备工程,包括建造地基及建基前之泥石挖掘工程;
(c)(a)段或(b)段所指任何工程所用之机器、装置、工具、设备及材料;
“集装箱”指一种用于运输的设备——(b)为便利货物运输而特别设计,可用于一种或多种运输方式,并无需中途重新装卸;
(c)为稳固或装卸目的而设计有接头配件;
(d)4个底角围起的面积符合下列尺寸——
(i)至少14平方米;或
(ii)如果它与顶部接头配件相对称,至少有7平方米。
“承建商”,就建筑工程而言,指任何以营业方式承担进行建筑工程之人士或公司,不论其为自行承担进行或因与别人,包括政府或任何公共机构所签订之合约或安排而承担进行该工程者;
“接头配件”指在集装箱顶部或底部(或两处都有)设计的一种起装卸、堆集或稳固作用的孔眼装置;
“危险性行业”指第一附表所指定之行业、工序或职业;
“工厂”指任何楼宇或地方(矿场与石矿场除外)而在该处进行物品制造、修改、清洗、修理、装饰、加工、改装出售、捣碎或拆除,或改变物料形质之工序,并在该处之庭园或园地以内有下列情形者——
(a)使用纯人力推动以外之任何机器;或
(b)有20名或以上人士受雇从事体力劳动。
“工业经营”包括——
(a)任何工厂;
(b)任何矿场或石矿场;
(c)任何从事物品之制造、修改、清洗、修理、装饰、加工、改装出售、捣碎或拆除,或改变物料形质之工序之业务,包括造船业;
(d)电力或任何种类动力之生产、变换或输送;
(e)任何建筑工程;
(f)任何船坞、轮船停泊所、码头、货仓或机场之货物起卸或处理;
(fa)任何集装箱的装卸、处理、堆卸、储存、管理或保管;
(g)煤、建筑物料或碎料之运输;
(h)从公路、铁路或以缆车或架空缆车系统运载乘客或货物;及
(ha)为有关处所的消费及销售准备食物;
(i)任何用以从事上述任何一种工业经营之楼宇或地盘,及从事该项经营所使用之机器装置、工具、设备及材料。
“督察”指根据第3条委任为首席工厂督察总监、副首席工厂督察总监、工厂督察总监、工厂督察分区主任、工厂督察或助理工厂督察、总劳工督察、高级劳工督察或劳工督察之人士;
“矿场”指从土地中开采矿物之工程或工程系统;
“矿物”包括——
(a)任何只能从开矿或探矿工程中获得之含金属矿物及其他在自然状态之物质;
(b)任何采得或从探矿工程中获得之含金属矿物及其他在自然状态之物质;
(c)该等矿物或其他物质未经加工之有价值部分;
(d)为推销或出口而处理或整理该等矿物或物质所得之产品;及
(e)高岭土;
惟不包括——
(i)高岭土以外之其他粘土;
(ii)花岗岩、斑岩、石炭岩或沙;
(iii)经总督根据《矿务条例》(第285章)在宪报公布就该条例之条款(不包括第3条)而言,不属矿物之普通矿物;或
(iv)任何矿物油;
“例须呈报工场”指——
(a)任何工厂,矿场或石矿场;及
(b)经营或拟经营危险性行业或附表所列行业之楼宇或地方,但不包括《建筑地盘(安全)规例》(第59章附属立法)所指之建筑地盘;
“禁制通知书”指根据第9a条第(1)款规定所发出之通知书;
“东主”就某一工业经营或例须呈报工厂而言,包括当时负责管理或控制该工业经营或例须呈报工厂之人,并包括法人团体、公司,及占用该工业经营或例须呈报工厂之人及该人之代理人;
“石矿场”指任何主要从土地中开采任何花岗岩、斑岩、石灰岩作商业目的之工程或工程系统;
“附表所列行业”指第二附表所指定之行业、工序或职业;
“青年”之意义与《雇佣条例》(第57章)所载之定义相同。
(2)就本条例之规定及根据本条例进行之诉讼而言,凡在工业经营内工作之妇女、青年或儿童,不论领取工资与否,亦不论其所从事之工作乃一项工序或清理该工业经营用以进行某项工序之任何部分,或清理或用油润滑机器或装置,或与该工序有关或由其所引起之其他工作,或与该工业经营之制品有关之工作或属于该工序之主要工作,均视为受雇于该处论。
(3)本条例之规定概不适用于——
(a)任何非以贸易方式或营利为目的而经营之机构;
(b)任何农业经营。
3.处长及其他人员之委任
总督得委任一名劳工处处长、多名副劳工处处长、助理劳工处处长、高级劳工主任、劳工主任、助理劳工主任、职业健康科雇问医生、高级职业健康科医生、职业健康科医生、助理职业健康科医生、职业环境卫生师、助理职业环境卫生师、一名首席工厂督察总监、多名副首席工厂督察总监、工厂督察总监、工厂督察分区主任、工厂督察、助理工厂督察、总劳工督察、高级劳工督察、劳工督察及其认为执行本条例所需之其他人员。
4.公职人员之权力
(1)根据第三条委出之处长、任何助理劳工主任或助理工业健康科医生,以及获劳工处处长以一般或特别书面授权之任何工业卫生师、督察及其他人员均有下列权力——
(a)于日夜任何合理时间进入所知或有理由相信内有工业经营之楼宇或地方视察及检查;
(b)〔已删除〕
(c)要求出示本条例规定须保存之任何登记册或其他文件,并加以查验、审阅及抄印副本;
(d)按需要进行检查及询问,借以确定本条例之规定有否遵行;并检去任何可能显示触犯本条例之证物;
(e)如其本人认为适当,得就与本条例有关事项,独自或有他人在场,检查工业经营内之任何人士,或其本人有理由相信曾于过去两个月内受雇于某一工业经营之人士,或着令该等人士接受检查并签署声明书,声明受检查之事项属实;
(f)着令在工业经营内雇用或曾雇用妇女、青年或儿童之人士,或该等雇主之代理人或仆人,提供其所拥有一切有关该等妇女、青年或儿童之资料,及有关该等雇主所雇用之每名妇女、青年或儿童之工作条件及待遇;
(g)带走任何在其本人有理由相信已触犯本条例之地方所发现之任何青年或儿童,并将其扣留于根据当时有效,并与妇女、青年或儿童有关之任何条例所指定之收容所内,以便进行调查;
(h)着令在指定之地点及期间,以指定之形式,张贴与本条例之规定或任何工业经营所从事之制造业或使用之机器、装置、工序或雇用之人士有关之通告;及
(i)行使根据本条例而制定之规例所赋予之任何其他权力。
(2)任何卫生科医生或获消防处处长书面授权之消防处人员或获劳工处处长特别授权之人员,可在任何时间进入任何工业经营视察,以确定本条例之规定有否遵行,但须遵从劳工处处长可能发出之指示。
(2a)任何人员在行使第(1)款所赋予之权力时,如有合理需要,可携同任何人士,不论其是否公职人员,以协助其执行本条例所规定之职务,尤其是有特殊专长而获劳工处处长聘用,以便就工业经营内雇员之安全及健康事宜,向处长提供意见之人士。
(2b)按照第(2a)款之规定而陪同有关人员执行职务之人士——
(a)可于该有关人员行使第(1)款所赋予之任何权力时,给予合理所需之协助;
(b)在执行第5及第6条方面而言,得视为公职人员。
(3)本条例赋予任何人员之权力乃补充而非取代该员所拥有之任何其他权力。
5.公职人员不得透露投诉来源等
(1)除第(4)款另有规定外,任何公职人员,在有人投诉指称有违反本条例之情事发生或在其本人或其他公职人员因该项投诉而知悉有上述违例情事发生时,不得向他人(其他执行职务之公职人员除外)透露该投诉人之姓名或身份。
(2)任何公职人员,不得向某工业经营东主或其代表或在该工业经营内营业之任何其他雇主或其代表透露,由于接获第(1)款所指之投诉后,而往该工业经营视察。
(3)除根据第(4)款外,任何公职人员,如因执行本条例或与本条例有关之职务而知悉任何生产或商业秘密或工作程序,则不论何时(纵然已辞去公职),均不得向任何人士透露该项秘密或工作程序。
(4)在任何诉讼中,法院或裁判司如认为维持司法公正有此必需,可下令公职人员透露第(1)款所指之投诉人姓名或身份,或透露第(3)款所指之秘密或工作程序。
6.雇员不得因在根据本条例而提出之诉讼中作供
而遭解雇
雇主不得因雇员有下开行为而终止雇用或恐吓终止雇用或以不公平之手段对待该员——
(a)该雇员曾在为执行本条例而进行之诉讼中作供或答允作供;或
(b)该雇员曾向为执行本条例或与执行本条例有关而提出询问之公职人员提供资料。
6a.东主之一般义务
(1)每一工厂之东主有责任,尽可能合理地,保证被其在该工厂工作的被雇佣者工作时的健康和安全。
(2)在不影响东主根据第(1)款应承担之一般义务之前提下,义务还应特别包括——
(a)工厂之供应与保养以及工作制度,尽可能地安全并对健康没有危险;
(b)在有关工具及物品的使用,操作,贮藏及运输过程中,尽可能保证安全并对健康没有危险;
(c)规定必要的资料、指示、训练及监督以尽可能保证被雇佣者在工厂的健康和工作中的安全;
(d)在东主控制之工厂的任何部分,应尽可能保持在一种安全、无危险状态,并保证进、出工厂的安全并对健康没有危险;及
(e)对在该工厂的所有被雇佣者来说,工作环境应尽可能保持安全并没有危险。
(3)除第(4)款另有规定外,违反本条规定之工厂东主均属违法,可判处三万元罚款。
(4)故意并没有合理解释地违反本条规定之任何工厂之东主,均属违法,可判罚款三万元及监禁六个月。
6b.雇员之一般义务
(1)任何工厂雇员在工作中的义务是——
(a)须对其本人,以及可能受其工作中的行为或懈怠影响之人士的健康及安全有合理的注意;
(b)对于本条例要求工厂东主或其他人为保证雇员健康及安全的义务或要求,雇员应予以配合,以保证这些义务和要求得以履行和遵守。
(2)违反第(1)款之任何人士均属违法,可判罚款一万元。
(3)任何雇员如在工作中故意,并且无合理理由从事任何可能威胁本人或其他人之行为,均属违法,可判罚款三万元及监禁六个月。
6c.“工作中”之含义
在第6a条和第6b条中,任何人在受雇佣过程中时,他始终处于工作中,而不是其他时候。
7.劳工处处长制订规例等之权力
(1)劳工处处长得就下开事宜为工业经营制订规例——
(a)禁止或管制危险性行业或附表所列行业雇用各类人士或任何类别人士;
(b)禁止或管制工业经营雇用妇女、青年及儿童及规定须保存受雇于工业经营之妇女、青年及儿童名册;
(c)规定雇用妇女、青年或儿童在工业经营内工作之人士或其代理人或佣人之责任,以确保其遵行本条例之规定;
(d)界定根据第3条委任之公职人员之职责及权力范围;
(e)豁免任何工业经营遵行本条例所有或部分规定;
(f)规定执行本条例所使用之表格及其印制方法;
(g)制订方法,使环境符合卫生条件;
(h)制订方法,确保工业经营内人士安全并使其免受工业经营内发生意外之后果影响;
(i)制订方法,消除任何危险或缺点;
(j)规定遇有意外或发生规例所指之危险事件时须予呈报;
(k)防火措施及走火通道之设置;
(l)抽取曾经使用或处理之材料或物质之样本进行分析;
(m)规定曾受雇或现受雇在工业经营内工作之人士患有关规例所指定之疾病时须予呈报;
(n)规定由卫生科医生或由有关工业经营之东主聘用之医生,为受雇或有意受雇于工业经营内工作之人士或某类别人士进行体格检验,并就该等检验保存记录;
(o)规定东主、承建商及雇员之职责;
(p)为执行本条例而作一般性之规定。
(2)(a)倘劳工处处长确实认为工业经营内所使用之任何制品、机器、装置、工序,或任何类别之体力劳动,其本身性质乃对受雇与上述所列者有关之人士,或任何类别之该等人士,有造成身体受伤之危险,则在不妨碍第(1)款授予制订规例之一般性权力之原则下,处长可制订其认为切实可行及合乎情况所需之特别规例,尤其系与下开事项有关者——
(i)禁止或管制雇用与任何制品、机器、装置、工序或任何类别之体力劳动有关之人士;或
(ii)禁止或管制使用任何材料或工序;
此外,亦可规定东主、承建商、受雇人士及其他人士之职责。
(b)根据上述规定制订之特别规例对所有使用制品、机器、装置、工序或各类体力劳动之工业经营,或任何指定种类或类别之工业经营,均属适用;此外,亦可规定在无条件或有条件之情况下豁免任何指定种类或类别之工业经营。
(3)劳工处处长制订之所有规例应呈交总督审阅,并须由立法局批准。
(4)劳工处处长可在其认为适当之情况下,按照其所订条件,豁免任何工业经营在其指定之期间内遵守根据本条例制订之任何规例;此外,劳工处处长或获其书面授权之人员可饬令其除采取根据本条例制订之规例所指定之预防措施外,另采取特别预防措施;
但任何人士如对该项豁免或命令感不满,可于接获有关该项豁免或命令之通知后14天内,以诉愿书向总督会同行政局提出上诉,而后者之决定即为最终决定。
(5)根据本条制订之规例可规定凡触犯该等规例之指定规定者,即属违法,亦可规定有关之罚款;
但该等规例所规定之罚款不得超逾五万元,监禁不得超过12个月。
8.总督会同行政局可修订附表
总督会同行政局可发出命令,修订第一、第二或第三附表。
9.工场须呈报资料
(1)例须呈报工场之管理人,在该工场开始进行任何工业程序或工业操作之前,应用规定表格将有关该工场及其拟经营之工业程序或工业操作之资料,通知劳工处处长。
(2)倘例须呈报工场拟更改其地点或名称或工业程序或工业操作之性质者,则该工场之管理人须在更改实行之前用规定表格将更改之资料通知劳工处处长。
(3)倘例须呈报工场管理人身份有所更改时,该人须于身份更改后21天内将更改之事实通知劳工处处长。
9a.禁制通知书
(1)无论何时,劳工处处长如认为任何例须呈报工场不适合作下列用途——
(a)工厂、矿场或石矿场;或
(b)在其内经营危险性行业或附表所列行业;或
(c)在其内进行任何工业程序或工业操作或部分工业程序或工业操作,则无论该工场曾否根据第9条之规定向其呈报,亦可以规定表格向该工场发出通知书禁止——
(i)该工场用作工厂、矿场或石矿场;
(ii)在其内经营任何危险性行业或附表所列行业;或
(iii)在其内进行通知书所指明之工业程序或工业操作或部分工业程序或工业操作。
(2)劳工处处长向任何例须呈报工场发出禁制通知书时,应在通知书内说明发出之理由并指定遵办日期。
(3)劳工处处长向例须呈报工场发出禁制通知书后,如认为令致发出该通知书之事项已获纠正,可撤销该通知书;但如今致发出通知书之事项已获纠正,而该工场东主提出要求,则必须将之撤销;在撤销通知书时并可就令致发出禁制通知书之事项,发出书面指令。
(4)任何例须呈报工场之东主,如对下开事项不满——
(a)向其工场发出禁制通知书;
(b)劳工处处长拒绝将禁制通知书撤销;或
(c)撤销禁制通知书时所发出之任何指令,
可于接获有关上述事项之通知后14天内,以诉愿书向总督会同行政局提出上诉;后者之决定,即为最终决定。
(5)在本条内——
(a)“劳工处处长”包括获劳工处处长书面授权执行本条规定之任何人士;
(b)“适合”——
(i)如该例须呈报工场乃专为工业用途而设计及建造者,则指在安全、健康及福利方面须适合所雇用员工在内工作;
(ii)如该例须呈报工场非专为工业用途而设计及建造者,则指在安全、健康及福利方面须适合一般人,但有关声音对非雇用者的影响除外。
10.罪项及罚则
(1)凡触犯第9条者,即属违法,可被判罚款一万元。
(1a)除第(1c)款另有规定外,任何例须呈报工场之东主,如在禁制通知书所指定之期间内,不遵照该通知书指定与该工场有关之所禁制事项办理,即属违法,可被判罚款三万元及监禁6个月。
(1b)倘例须呈报工场东主根据第9a条第(4)款之规定向总督会同行政局提出上诉,则遵照禁制通知书所禁制事项办理之期间应在上诉判决书内注明,如判决书并无注明,则应由东主接获上诉结果之日起计算。
(1c)倘劳工处处长在撤销其对某例须呈报工场发出之禁制通知书时根据第9a条第(3)款发出任何指令,该工场之东主如不遵照该等指令办理而继续在该工场内进行某项工业程序或操作者,即属违法,可被判罚款三万元及监禁6个月。
(2)任何人士,如不遵守根据第7条第(4)款所发出之命令或根据该款而给予任何豁免权所附加之任何条件,即属违法,可被判罚款三万元及监禁6个月。
(3)任何人士,如有下开行为,即属违法,可被判罚款二万元——
(a)不遵守任何人员根据第四条第(1)款所作之任何规定;或
(b)对于第4条第(1)款规定须提供资料之事项,蓄意或不顾后果胡乱提供虚假资料,或隐瞒资料;或
(c)阻碍或阻延任何人员行使第四条所赋予之权力。
(4)任何人士,如触犯第5条第(1)、第(2)或第(3)款之规定,即属违法,可被判罚款一万元。
(4a)任何人士,如触犯第6条之规定,即属违法,可被罚款二万元。
(5)倘例须呈报工场在1985年工厂暨工业经营(修订)条例开始实施之前,经已根据已废除之第9条第(5)款注册或临时注册,则该工场之东主即视为已遵照第9条第(1)款之规定办理论。
(6)倘任何例须呈报工场于1985年工厂暨工业经营(修订)条例实施之前即属已废除之第9条第(1)款所指之例须注册工场,但并未根据已废除之第九条第(5)款之规定注册或临时注册,则劳工处处长可于该条例实施后六个月内发出通知书,豁免该工场之东主遵守第9条第(1)款之规定。
(7)在本条内,“已废除”指由1985年工厂暨工业经营(修订)条例第5条所废除者。
11.就消除危险情况及危险行为发出命令之权力
(1)纵使第9a条已有规定,裁判司如在督察提出之申诉中,认为确实有下开情况出现——
(a)工业经营所使用之通道、厂房、机械或装置之任何部分,其情况、结构或放置地点使该部分为人使用时会有身体受伤之危险;或
(b)在工业经营内进行之任何工序或工作,或所办理或已完成之任何事项,其进行或办理方式足以引致危险或导致身体受伤,
则可按情况之需要而发出命令——
(i)禁止使用该通道、厂房、机械或装置之有关部分;如该部分可予修理或更改,则禁止在该部分获得修理或更改妥善前予以使用;
(ii)着令东主采取命令所指明之步骤,以改善督察所申诉之危险情况;或
(iii)饬令该机械或装置在其命令所指定期间须由督察用封条、锁或其他器具紧系,而紧系之方法乃督察认为可以防止机械或装置在不损毁或移去封条、锁或其他器具之情况下操作。
(2)倘督察根据第(1)款规定提出或已提出申诉,裁判司在督察单方面提出申请,及接获证据证明该通道、厂房、机械或装置之使用,或任何工序或工作之进行或任何事项之办理等方法乃有如上述可能迅即引致严重身体受伤后,可发出临时令,在无条件或有条件下禁止上述之使用、进行或办理情事,直至有机会举行聆讯及裁定该项申诉之结果时为止;此外,并可在该临时令内加入一项指令,饬令放置在该工业经营内之任何机械或装置须由督察用封条、锁或其他器具紧系,而紧系之方法乃督察认为可以防止机械或装置在不损毁或移去封条、锁或其他器具之情况下操作,此外,如已发出临时令或指令,则裁判司可随时将之撤销或更改。
(3)倘工业经营东主有违反或不遵守裁判司根据本条所发出之命令,或该等命令所载之条件或指令,即属违法,可被判罚款五万元及监禁12个月。
11a.如有意外事件,首席工厂督察总监可进行研讯
(1)倘工业经营内有意外事件发生,则不论是否有人因而受伤,劳工处处长如认为应对意外事件之起因及实况进行研讯,可饬令首席工厂督察总监进行是项研讯。
(2)首席工厂督察总监须按照其认为适当之方式先进行非正式研讯;此外,该首席工厂督察总监须以书面将其调查结果记录,及将该项记录呈交劳工处处长。
(3)倘首席工厂督察总监认为根据本条规定由其本人进行之研讯可能由于某人不愿意提供有关该意外事件之资料、或出示簿册或记录以供查阅、或答复任何问题,或因任何其他原因而受到阻挠或延误,则该首席工厂督察总监须向劳工处处长呈交一份陈述书,说明有关情况。
11b.处长或副处长进行正式研讯之权力
(1)倘有关任何意外事件之陈述书经已根据第11a条第(3)款呈交劳工处处长,则劳工处处长或劳工处副处长可对该意外事件之起因及实况进行研讯。
(2)为进行研讯起见,劳工处处长或劳工处副处长——
(a)得具有裁判司之一切权力,即传召证人、着令出示簿册及文件,以及在证人及其他有关人士宣誓后加以查问之权力;及
(b)于接获申请后,如其本人认为在听取证供时可能会揭露业务上之秘密,而又认为有此需要时,则在此种情形下可进行非公开形式研讯。
(3)任何被传召人士,如拒绝出席根据本条进行之研讯或在该项研讯中出示簿册或文件作为证据,或拒绝答复研讯主持人所提出或获其同意而提出之问题,即属违法,可被判罚款一万元及监禁三个月;
但任何人士均不得被迫提供对其本身不利之证供,同时证人在研讯中作证时所享有之特权,与其出席由裁判司审理之诉讼案中作证时所享有者无异。
(4)任何人士,如对研讯主持人或在研讯主持人在场时作出无礼行为,或使用恐吓性或侮辱性辞语,即属违法,可被判罚款五千元及监禁三个月。
11c.保留条文
按照第11b条进行之任何研讯,均对死因裁判官根据《死因裁判官条例》(第14章)规定所可行使之裁判权力并无任何损减。
12.持续触犯罪项
任何人士,如触犯本条例所指之任何罪项,则除须被判处本条例对该罪项所规定之刑罚外,并须按照其明知而故意持续违犯该罪项之期间,每日(全日或其任何部分均作一日计算)另判罚款五千元。
13.东主之责任
(1)除根据本条例所制订之规例另有规定外,任何工业经营,如其内曾发生触犯本条例所指罪项之情事,或曾与触犯本条例所指罪项有关,则其东主即犯同罪,可被判处本条例对该罪项所规定之刑罚。
(2)任何工业经营东主,如被控触犯本条例所指罪项,均不得以事前对该罪项并不知情或该罪项未经其同意,或真正犯事者仍未被判触犯该罪项等情事,作为辩护理由。
(3)本条规定不适用于第六b条规定的违法行为。
14.董事、合伙人等之责任
(1)倘被判处触犯本条例所指罪项者为一公司,并且证实该罪项是在该公司任何董事,经理,秘书或其他人士的同意或默许下进行的,或者在一定程度上可归咎于该等人士,则上述人士即犯同罪。
(2)倘被判触犯本条例所指罪项者为一商号,并且证实该罪项是在该商号任何合伙人或与该商号之管理有关之人士同意或默许下进行的,或者一定程度上可归咎于该等人士,则上述人士即犯同罪。
14a.公职人员之保护
(1)倘若任何公职人员善意认为有此必要,或者依据本条例行使授与他的职责、义务或权力,则对他的有关行为或遗漏不承担个人责任。
(2)第(1)款对于公职人员行为或遗漏之保护并不影响政府对该等行为或遗漏之侵权行为责任。
15.程序
(1)(a)凡关于工业经营东主触犯本条例所指罪项之传票,如留交该传票所提及之工业经营内该东主之任何代收人,即作送达论。
(b)上述传票可书明“工业经营东主收”,而毋须叙明东主之姓名。
(c)在聆讯与传票有关之诉讼时,裁判司如认为有关罪项经已证明属实,则除可行使其可拥有之其他权力外,可下令如任何判处之罚款不依时缴交,则可将在工业经营内发现之机器、货品及一般动产扣押及售卖,以收回该笔款项;此外,《裁判司条例》(第227章)之规定,对该项扣押及售卖均属适用,一如其适用于根据该条例所进行之扣押及售卖者。
(2)凡关于工业经营雇员触犯本条例所指罪项之传票,如留交其最后所知或通常住址内该雇员之任何代收人,或传票所提及之工业经营内该雇员之任何代收人,即作送达论。
16.推定
在根据本条例提出之检控中——
(a)倘裁判司认为在该宗检控中被指在犯罪当日为青年或儿童之人在该日实为一名青年或儿童,则除能提出反证外,可推定该人在该日为一名青年或儿童;
(b)倘裁判司认为在该宗检控中被指在犯罪当日未达到某一年龄之青年或儿童在该日实未达到该年龄者,则除能提出反证外,可推定该青年或儿童在该日仍未达到该年龄;
(c)倘该项检控乃关于触犯本条例内有关禁止或管制雇用妇女、青年或儿童之规定,而被告乃被指发生该违例事件/或与该违例事件有关之工业经营东主,则除能提出反证外,可推定该等与控罪有关,并在所指违例事件发生当日在该工业经营受雇之任何妇女、青年或儿童当日乃受该东主雇用。
17.关于罪项之检控
(1)凡有关本条例所指罪项之检控,可以劳工处处长名义提出,并由劳工处人员进行。
(2)除根据第(1)款规定所提出之检控外,有关本条例所指之罪项,如未得劳工处处长书面同意,均不得提出检控。
(3)本条所载之规定,均不得视作对律政司检控刑事罪项之权力有所损减。
18.证明可行之限制的责任
(1)在一项根据本条例规定有关未能遵循必要义务或要求而发生之违法诉讼中,法律要求的“可行的”、“尽可能合理地”、“采取一切合理措施”、“所有可能之措施”、“充分措施”或“所有可能合理之措施”等等,须由被告证明事实上他已经尽其最大可能履行其义务和要求,或者他已经采取了所有合理之措施,或可能之措施或做了适当之行为去遵循其义务或要求。
(2)在一项根据本条例规定有关免除遵循有关义务或要求而发生之诉讼中,被告有责任证明事实上尽其最大可能履行该等义务或要求是不可行的或有悖常理的。
(3)第(1)及(2)款不适用于在本条生效之日或以前所犯罪项。
19.民事责任
本条例不——
(a)对于未能遵循第6a或6b条之行为,授与民事诉讼之权利;及
(b)影响任何触犯其他规定可控诉行为的范围(若有的话)。

6.employmentnottobeterminated,etc.byreasonoffactthatemployeehasgivenevidenceinproceedingsunderordinance,etc.noemployershallterminate,orthreatentoterminate,theemploymentof,orinanywaydiscriminateagainst,anyofhisemployeesbyreasonofthefactthattheemployeehas-(a)givenevidence,oragreedtogiveevidence,inanyproceedingfortheenforcementofanyoftheprovisionsofthisordinance;or(b)giveninformationtoapublicofficerinanyinquirymadebysuchofficerforthepurposesoforinconnexionwiththeenforcementofanyoftheprovisionsofthisordinance.(added51of1961s.3.amended4of1969s.5)6a.generaldutiesofaproprietor(1)itshallbethedutyofeveryproprietorofanindustrialundertakingtoensure,sofarasisreasonablypracticable,thehealthandsafetyatworkofallpersonsemployedbyhimattheindustrialundertaking.(2)withoutprejudicetothegeneralityofaproprietor'sdutyundersubsection(1),thematterstowhichthatdutyextendsincludeinparticular-(a)theprovisionandmaintenanceofplantandsystemsofworkthatare,sofarasisreasonablypracticable,safeandwithoutriskstohealth;(b)arrangementsforensuring,sofarasisreasonablypracticable,safetyandabsenceofriskstohealthinconnectionwiththeuse,handling,storageandtransportofarticlesandsubstances;(c)theprovisionofsuchinformation,instruction,trainingandsupervisionasisnecessarytoensure,sofarasisreasonablypracticable,thehealthandsafetyatworkofallpersonsemployedbyhimattheindustrialundertaking;(d)sofarasisreasonablypracticableasregardsanypartoftheindustrialundertakingundertheproprietor'scontrol,themaintenanceofitinaconditionthatissafeandwithoutriskstohealthandtheprovisionandmaintenanceofmeansofaccesstoandegressfromitthataresafeandwithoutsuchrisks;and(e)theprovisionandmaintenanceofaworkingenvironmentforallpersonsemployedbyhimattheindustrialundertakingthatis,sofarasisreasonablypracticable,safe,andwithoutriskstohealth.(3)subjecttosubsection(4),aproprietorofanindustrialundertakingwhocontravenesthissectioncommitsanoffenceandisliabletoafineof$30,000.(4)aproprietorofanindustrialundertakingwhocontravenesthissectionwilfullyandwithoutreasonableexcusecommitsanoffenceandisliabletoafineof$30,000andtoimprisonmentfor6months.(added71of1989s.5)
6b.generaldutiesofpersonsemployed(1)itshallbethedutyofeverypersonemployedatanindustrialundertakingwhileatwork-(a)totakereasonablecareforthehealthandsafetyofhimselfandofotherpersonswhomaybeaffectedbyhisactsoromissionsatwork;and(b)asregardsanydutyorrequirementimposedonaproprietoroftheindustrialundertakingoronanyotherpersonbythisordinanceforsecuringthehealthandsafetyofpersonsemployedattheindustrialundertaking,toco-operatewithhimsofarasisnecessarytoenablethatdutyorrequirementtobeperformedorcompliedwith.(2)apersonwhocontravenessubsection(1)commitsanoffenceandisliabletoafineof$10,000.(3)apersonemployedatanindustrialundertakingwhowilfullyandwithoutreasonableexcusedoesanythingwhileatworklikelytoendangerhimselforotherpersonscommitsanoffenceandisliabletoafineof$30,000andtoimprisonmentfor6months.(added71of1989s.5)6c.meaningof"atwork"forthepurposesofsections6aand6b,apersonisatworkthroughoutthetimewhenheisinthecourseofemployment,butnototherwise.(added71of1989s.5)
7.powerofcommissionerforlabourtomakeregulations,etc.(1)thecommissionerforlabourmayinrespectofindustrialundertakingsbyregulationprescribeorprovidefor-(a)prohibitingorcontrollingtheemploymentofallpersonsoranyclassofpersonsindangeroustradesorscheduledtrades;(b)prohibitingorcontrollingtheemploymentofwomen,youngpersonsandchildreninindustrialundertakings,andrequiringregisterstobekeptofwomen,youngpersonsandchildrenemployedinindustrialundertakings;(c)imposingobligationsforsecuringcompliancewiththeprovisionsofthisordinanceuponpersonswhoemploywomen,youngpersonsorchildreninindustrialundertakingsandupontheagentsandservantsofsuchpersons;(d)definingthedutiesandpowersofallofficersappointedundersection3;(amended10of1965s.5)(e)exemptinganyindustrialundertakingfromtheoperationofthisordinanceoranypartthereof;(f)theformstobeusedforthepurposesofthisordinanceandthemannerofpublishingsuchforms;(replaced50of1985s.3)(g)meansofsecuringhygienicconditions;(h)meansofensuringthesafetyofpersonsinindustrialundertakingsandofrelievingpersonssufferingfromtheeffectsofaccidentsinindustrialundertakings;(replaced4of1969s.6)(i)meansofsecuringtheremovalofanydangerordefect;(j)requiringnotificationstobemadeinrelationtoaccidentsandsuchdangerousoccurrencesasmaybespecifiedintheregulations;(k)precautionstobetakenagainstfireandprovidingformeansofescapefromfire;(l)thetakingforpurposesofanalysisofsamplesofmaterialsorsubstancesusedorhandled;(m)requiringnotificationstobemadeinrelationtotheoccurrenceamongstpersonwhohavebeenorareemployedinindustrialundertakingsofsuchdiseasesasmaybespecifiedinsuchregulations;(n)requiringthemedicalinspectionbyahealthofficerorbyamedicalpractitioneremployedbytheproprietoroftheindustrialundertakingconcernedofanypersonorofanyclassofpersonemployedorintendedtobeemployedinanyindustrialundertaking,andthekeepingofrecordsofanysuchinspections;(amended4of1969s.6)(o)imposingdutiesonproprietors,contractorsandpersonsemployed;(amended52of1973s.3)(p)generally,carryingintoeffecttheprovisionsofthisordinance.(2)(a)wherethecommissionerforlabourissatisfiedthatanymanufacture,machinery,plant,processordescriptionofmanuallabour,usedinindustrialundertakingsisofsuchanatureastocauseriskofbodilyinjurytopersonsemployedinconnexiontherewith,oranyclassofthosepersons,hemay,withoutprejudicetothegeneralityofthepowertomakeregulationsundersubsection(1),makesuchspecialregulationsasappeartohimtobereasonablypracticableandtomeetthenecessityofthecaseandinparticularsuchspecialregulationsmay-(i)prohibitorcontroltheemploymentofallpersonsoranyclassofpersonsinconnexionwithanymanufacture,machinery,plant,process,ordescriptionofmanuallabour;or(ii)prohibitorcontroltheuseofanymaterialorprocess;andmayimposedutiesonproprietors,contractors,employedpersonsandotherpersons.(amended52of1973s.3)(b)specialregulationssomademayapplytoallindustrialundertakingsinwhichthemanufacture,machinery,plant,process,ordescriptionofmanuallabourisusedortoanyspecifiedclassordescriptionofsuchundertaking,andmayprovidefortheexemptionofanyspecifiedclassordescriptionofundertakingeitherabsolutelyorsubjecttoconditions.

15.procedure(1)(a)anysummonsrelatingtoanoffenceagainstthisordinancebyaproprietorofanindustrialundertakingmaybeservedbyleavingacopyofthesummonswithsomepersonforhimattheindustrialundertakingmentionedinthesummons.(b)anysuchsummonsmaybeaddressedtotheproprietorofanindustrialundertakingwithoutspecifyingthenameoftheproprietor.(c)ifonthehearingofanysuchsummonstheoffenceisprovedtothesatisfactionofthemagistrate,hemay,inadditiontoanyotherpowerwhichhemaypossess,orderthatanyfineimposed,ifnotdulypaid,shallberecoveredbydistressandsaleofthemachinery,goodsandchattelsfoundintheindustrialundertakinginquestion,andtheprovisionsofthemagistratesordinance(cap.227)shallapplyinthecaseofsuchdistressandsaleastheyapplytoanydistressandsaleunderthatordinance.(2)anysummonsrelatingtoanoffenceagainstthisordinancebyapersonemployedinanindustrialundertakingmaybeservedbyleavingacopyofthesummonseitherwithsomepersonforhimathislastormostusualplaceofabodeorwithsomepersonforhimattheindustrialundertakingmentionedinthesummons.
16.presumptionsinanyprosecutionunderthisordinance-(a)ifitappearstothemagistratethatanypersonwhoisallegedinthechargetohavebeenayoungpersonorchildatthedateoftheallegedoffencewasayoungpersonorchildatthesaiddate,itshall,untilthecontraryisproved,bepresumedthatsuchpersonwasayoungpersonorchildatthesaiddate;(b)ifitappearstothemagistratethatanyyoungpersonorchildwhoisallegedinthechargetohavebeenunderanyparticularageatthedateoftheallegedoffencewasunderthatparticularageatthesaiddate,itshall,untilthecontraryisproved,bepresumedthatthesaidyoungpersonorchildwasunderthesaidageatthesaiddate;(c)ifthechargeallegesthecontraventionofanyoftheprovisionsofthisordinanceprohibitingorcontrollingtheemploymentofwomen,youngpersonsorchildrenandthedefendantinsuchprosecutionistheproprietoroftheindustrialundertakinginorinrespectofwhichtheoffenceisallegedtohavebeencommitted,itshall,untilthecontraryisproved,bepresumedthatanywoman,youngpersonorchildtowhomthechargerelatesandwhowasemployedintheindustrialundertakingonthedayonwhichtheoffenceisallegedtohavebeencommittedwasemployedthereinonthatdaybysuchproprietor.(added51of1961s.5)17.prosecutionofoffences(1)prosecutionsforoffencesagainstthisordinancemaybebroughtinthenameofthecommissionerforlabour,andmaybecommencedandconductedbyanyofficerofthelabourdepartment.(2)saveasisprovidedinsubsection(1),noprosecutionforanoffenceagainstthisordinanceshallbecommencedwithoutthewrittenconsentofthecommissionerforlabour.(3)nothinginthissectionshallbedeemedtoderogatefromthepowersoftheattorneygeneralinrelationtotheprosecutionofcriminaloffences.18onusofprovinglimitsofwhatispracticable,etc.(1)inaproceedingforanoffenceunderaprovisioninthisordinanceconsistingofafailuretocomplywithadutyorrequirementtodosomethingsofarasisnecessary,wherepracticable,sofarasisreasonablypracticable,orsofaraspracticableortotakeallreasonablesteps,allpracticablesteps,adequatestepsorallreasonablypracticablestepstodosomething,theonusisontheaccusedtoprovethatitwasnotnecessary,notpracticableornotreasonablypracticabletodomorethanwasinfactdonetosatisfythedutyorrequirement,orthathehastakenallreasonablesteps,orpracticablestepsordonetheappropriatethingtosatisfythedutyorrequirement.(2)inaproceedingforanoffenceunderaprovisioninthisordinanceconsistingofanexemptionfromcompliancewithadutyorrequirementtodosomethingwhereitisimpracticable,notreasonablypracticableorrenderedimpracticabletocomplywiththatdutyorrequirement,theonusisontheaccusedtoprovethatitwasimpracticableornotreasonablypracticabletodomorethanwasinfactdonetocomplywiththedutyorrequirement.(3)subsections(1)and()donotapplywheretheoffenceiscommittedonorbeforethecommencement[1]ofthissection.(added71of1989s.12)
